Lien Waivers: Form is the Function

Lien waivers under Georgia law are controlled by O.C.G.A section 44-14-366.

A lien can’t be waived unless: 1) a waiver and release form has been completed by the lien claimant; and 2) the lien claimant has been paid for the claim. O.C.G.A.§ 44-14-366(b)(1) and (2).

The right to claim a lien or to claim upon a bond cannot be waived in advance of furnishing labor, services or materials. In other words a lien waiver signed and dated before the service, labor or materials have been furnished is unenforceable.

The Form. . . The waiver and release form, whether interim or final, shall “substantially” follow the form set forth by O.C.G.A. § 44-14-366(c) (interim lien waiver[i]) or O.C.G.A. § 44-14-366(d) (final lien waiver[ii]) in of boldface capital letters in at least 12 point font.

The interim lien waiver and final lien waiver must be dated, signed by the person providing the labor, service or materials and witnessed by one witness.

There is no language contained in O.C.G.A. § 44-14-366 which states that the filing of the interim lien waiver or final lien waiver is required.
